The project involves the labor, material, supervision, equipment, tools, and all the incidentals required to complete the entire skate park and site improvement project as per specifications and drawings. The city of Buda does not anticipate issuing project Change Or- ders. Prospective bidders must read the Instructions to Bidders, Contract Documents, and Detailed Specifica- tions and submit a Bid Bond along with their Bid to be considered for award. Bids must be submitted on the PROPOSAL AND BID SCHEDULE forms provided, and must be accompanied by a bid security in a penal sum approximately equal to and not less than five percent (5%) of the total amount of the bid. The security may be in the form of a certified check, cashier's check, or bid bond furnished by a reliable surety company having au- thority under the laws of Texas to write surety bonds in the amount required, with such security made payable without recourse to the city. Specialty skate park items will require the contractor performing these items to be pre-qualified. This pre-qualification is required for specialty skate park items only. Other work nor- mally performed by a general contractor (site grad- ing, drainage, paving, cast in place concrete, con- crete flatwork, landscaping, irrigation, site lighting, building construction, etc.) that is considered site work does not require pre-qualification. The final NOTICE OF AWARD of Contract shall be given to the successful bidder by the city within sixty (60) days following the opening of bids and no bidder may withdraw his bid within sixty (60) days after open- ing thereof. The successful Bidder must furnish a PER- FORMANCE BOND and PAYMENT BOND on the forms provided within these Contract Documents, each in the amount of one hundred percent (100%) of the contract amount, from a surety company holding a permit from the State of Texas to act as surety. State statutes includ- ing wage and hour provisions and contract regulations must be adhered to as they relate to this Project. Con-. tractors will be required to comply with all applicable Equal Employment Opportunity laws and regulations. The successful bidder will be required to enter into a contract for the performance of the work for the price quoted in the Bid and will provide evidence of current Personal Injury, Property Liability, Worker's Compensa- tion, and Builder's Risk Insurance. In addition, required bonds will need to be submitted. The Contractor will also be required to submit a Reference and Qualifica- tions statement. This form must be complete with the most recent similar type projects within the past three years and other current information. The bid will be awarded to the lowest responsible bidder whose bid is determined to be the most advan- tageous to the City, its officers, employees, and agents. The City will evaluate the bid based on the criteria listed in Texas Government Code 2267.055(a) including but not limited to price; offeror's experience/reputation; quality of goods or services; impact on ability to use HUBs; safety record; proposed personnel; offeror's fi- nancial capability. Price, in accordance with law, will not be the sole evaluation factor. Misrepresentation, whether substantial or otherwise, at any stage of the bidding and award process, shall be considered in this and all future bids in determining whether or not a bid is "responsible". THE CITY OF BUDA, IN ACCORDANCE WITH LAW, RESERVES THE RIGHT TO REJECT ANY AND ALL BIDS. The right is also reserved to eliminate a portion of the work or add additional work as required to keep the total contract amount within the funds budgeted.
