Co-owner Sama ttha Bellows, a 28-year-old Kyle f sident, pleaded in front of he council for a change in the Tpeddlers, solicitors and vend)rs regula- tion, which requirethat all retail business be cmducted in a fully enclosed buipding on an engineered foundation. "Let us work hen ," she said. "Let us provide a ni :e outing for our famih'es. Let us help you with the sales tax." Bill Sinor, anotht r Kyle resident and snow q one vendor, also urged the cour :il to help these types ofsmaI businesses, like his. "For over a year Iee been try- ing to do business i L Kyle," he said. "It's pretty sad hat I have to go to San Marcos Manchaca, Buda to do busines, ." If the regulation is relaxed, some city officials t ear an onslaught of vendt rs litter- ing the streets and :reating an eyesore. "Based on our eq erience, it would be our vie, that ffthe [City] Code or the cl trrent in- terpretation would 1 )e changed to allow such venders, there would definitely be more than just one 'snow cone stand' - and possibly a proli .ration of such vendors in the 2ity," said a memorandum si md by the Kyle Planning Direcl or Shira Rodgers and buildh g official Mario Perez. However, there h sift been "an influx of large pr portions" of vendors in other t lays County communities that ai ready grant permission, Bellows said. A deputy attempted to pull over Sosa because his motor- cycle matched the description of a bike that had evaded an earlier stop by another agenc3. The mo- torcycle then sped off, traveling at estimated speeds of more than 100 mph in 35 mph speed zones, before crashin Wade said. There were no other injuries. Sinor understands that city staffwants to avoid "junk trail- ers" in the city but says his trail- ers are the complete opposite. "We don't want to have a bunch of trash sitting around here but both of my trailers are professional concession trail- ers," he said. "Let us work in our home." Mayor Lucy Johnson sup- ported a change to the regula- tion as long as the vendors complied with proper health standards. "I think snow cone stands are cool," she said. "I think it would be a good thing for Kyle." Councilmember Michelle Lopez was leery that the move would create future problems. "I understand the need to want to open up oppornmi- ties for local business owners in town," she said. "[But] this opens the floodgates for many other things, and I'm not sure that's what we really want." Johnson countered by saying, "For me, I think that this is a possible floodgate that I'd be happy with." City staffers told Bellows that she could rent out a lot on city- owned parkland at $50 daily, or about $1,500 monthly. She would also have to purchase her own generator. Bellows' group presently has a tentative agreement to rent the empty lot at the comer of Center Street and Old Highway 81 for $350 monthly, with electricity and wastewater included. "The city staff has no prob- lem with us operating on their property [for rent] so there's obviously ways that this can be allowed," Bellows said. "It's just that the city won't receive the rent if we move elsewhere." y in prison sexual acts with a child charge, as well as an earlier assault ca jsing bodi- ly injury charge, at :cording to court records. An arrest affidav t says that McFall met the teen age boy on Craigslist, where the victim told McFall that he was years old. The boy disclosed to police that he performed oral sex on McFaU two separate times at the sus- pect's home. On October 1, 2009, Kyle po- lice responded to an assault call at the suspect's home. A second arrest affidavit says that McFall and his wife had a third man at their house. A tussle broke out between all three, and in the af- termath, McFall was arrested for grabbing his wife as she tried to escape the home.
